Terms of Service

1. Acceptance of Terms

a. By using the App, you agree to these Terms of Service and any additional terms and conditions that may apply to specific features or services.

b. You must be at least 16 years old to use the App.

2. Account Registration

a. Trainers and clients must create an account to use the App.

b. You are responsible for maintaining the confidentiality of your account credentials.

3. Client Payments and Transaction Fees

a. Trainers supply coaching services to their clients. For new packages using trainer-owned Stripe payments, the trainer is the payment recipient and merchant of record. The client pays the package's listed amount in its stated currency, including for recurring payments.

b. BULK takes no transaction commission on these payments. Stripe charges the trainer its applicable fees, which reduce the trainer's proceeds or are billed separately by Stripe. Fees can vary by the trainer's country, payment method, card origin, currency conversion, recurring billing and other Stripe services. BULK does not guarantee a fixed net payout.

c. Trainers handle client payment enquiries, refunds and disputes through their Stripe account. Clients should contact their trainer about the coaching service or a refund. Stripe's applicable refund and dispute fees still apply. A refund does not automatically cancel future subscription payments. Nothing in these terms excludes rights under applicable consumer law.

d. The package currency does not change based on the client's location. A client's bank or card issuer may convert the payment and charge its own foreign-transaction fees. Stripe may separately convert proceeds into the trainer's settlement currency.

e. The trainer's BULK software subscription is separate from client coaching payments and remains subject to its own pricing and cancellation terms. Deleting a BULK account cancels its ongoing coaching subscriptions; it does not automatically refund completed payments or close the trainer's Stripe account. Trainers remain responsible for any outstanding client refunds and disputes.

4. Use of the App

a. The App is intended for personal and professional use by trainers and clients.

b. You agree not to use the App for any illegal or unauthorized purpose.

5. Communication

a. Trainers and clients can communicate through the App's messaging and chat features.

b. Communication should be respectful, and users should not engage in any form of harassment or abusive behavior.

6. Content Assignment

a. Trainers can assign external content (links to Google Docs, Sheets, Slides, Keep, Notion, Zoom, etc.) to clients.

b. Clients are responsible for accessing and utilizing assigned content.

7. Privacy

a. The collection and use of personal information are governed by our Privacy Policy.

b. Trainers and clients are expected to respect each other's privacy within the App.

8. Intellectual Property

a. The App and its content are protected by intellectual property laws. Users may not reproduce, distribute, or create derivative works without permission.

9. Termination

a. BULK reserves the right to terminate or suspend your account at any time, with or without cause.

b. You may terminate your account by following the instructions in the App.

10. Changes to Terms of Service

a. BULK may update or modify these Terms of Service at any time.

b. Users will be notified of changes through the App or via email.

11. Limitation of Liability

a. BULK is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of the App.

12. Governing Law

a. These Terms of Service are governed by and construed in accordance with the laws of Australia.
